Recent Developments in the Class Action Case

The class certification hearing was held before Judge Shelby in the Federal District Court for the District of Utah on August 19, 2014.  The parties previously submitted briefing relative to the motion for class certification filed by plaintiffs November 1, 2013. 

UPDATE, May 2, 2018

Judge Robert Shelby of the Federal District Court for the District of Utah approved the class notice plan submitted by Class Counsel following class certification. Class notice documents can be found under the Class Notice tab and postcards with relevant information were mailed to the last known address for class members today. A copy of the postcard can be found under the Class Notice tab.

UPDATE, February 1, 2017

Yesterday, Judge Shelby of the Federal District Court for the District of Utah issued his decision on the Plaintiffs' motion for class certification in Roberts, et al. v. C.R. England, et al.  The Court also ruled on the Defendants' motions for partial judgment on the pleadings and partial summary judgment. 

Judge Shelby ultimately certified a nationwide class on claims for violations of the Utah Business Opportunity Disclosure Act, the Utah Consumer Sales Practices Act and the Utah Truth in Advertising Act, as well as common law claims for fraud, negligent misrepresentation, unjust enrichment and breach of fiduciary duty for all Independent Contractor lease operators who meet the following criteria:

  1. signed the Vehicle Leasing Agreement with Horizon,
  2. signed the Independent Contractor Operating Agreement with England,
  3. during the applicable statute of limitations period, and
  4. drove at least one day as an IC lease operator for England.
